Terms & Conditions for Curamio Ltd (trading as Curam) – Republic of Ireland

Terms & Conditions (T&Cs)

By accepting these T&Cs, you accept the T&Cs of all the Ecare group of companies, including Curamio Ltd, Curam PAYE Ltd, and other subsidiaries. You do so in your capacity as a client of the platform (including, but not exclusively either privately funded, hospital group funded, HSE/CHO funded, or any corporate or charitable body) or as an approved (or unapproved) Care Professional on the platform.

Definitions

“Account holder” means individuals, an incorporated body, or a charity using the Curam platform to search or advertise for domiciliary care and/or engage to hire Care Professionals and enter into a service agreement with Care Professionals.

“Care notes” means a feature in the client and the Care Professional app where, with the client’s authorisation (and if different, the care recipient’s permission), the Care Professional can make relevant and appropriate notes and attach photographs to the care note feature. This is optional and does not constitute oversight or supervision by Curamio Ltd.

“Care recipient” means an individual or incorporated body that is receiving care from an approved Curam carer via the Curam Platform. The account holder and the care recipient can be the same person.

“Care Professional”, “care assistant,” “care worker” and “personal assistant” are interchangeable terms for approved Care Professionals on the Curam platform.

“Client” is the term used to describe an account holder in the context of their contractual relationship with a Care Professional.

“Curam” or the “Curam platform” is the brand name of the Ecare group of businesses, a cloud and app-based health tech software platform and management system for health and social care, provided in Ireland via www.curamcare.ie.

“Commercial/Institutional account holders” are non-individual account holders such as hospital groups, HSE, care homes, charities, case management companies, domiciliary care agencies, neutral vendors, employee benefits providers, and other third parties who may transact on the platform under different terms and conditions and, in particular, individual terms of credit.

“Curam Managed Care Services” (future service): Curam intends to offer a HIQA-regulated agency service in Ireland, where Curam’s care experts will manage all aspects of the contractual relationship between clients and their Care Professional, providing regulated care packages when either requested or required. This service is not currently available in Ireland. All care provided through the platform is currently unregulated and arranged directly between clients and Care Professionals.

“Curam Meet Video/Audio call” refers to the on-platform, in-app call facility available for Care Professionals and clients to communicate safely and securely through Curam.

“Ecare Group Ltd” means the holding company of the Curam group of companies.

“Free hour of care” means an introductory offer, currently only for new clients, for one free hour of care, paid for by Curam up to a value of €20 for the hour of care.

“Placement fee” means the fee that Curam is entitled to charge any account holder that makes an offer to employ or hire a Care Professional directly (i.e., attempts to directly hire a Care Professional off the Curam platform).

“PAYE” means ‘pay as you earn’.

“Privately funded” means the client is responsible for their own funding.

“Service agreement” is the initial agreement generated between the Care Professional and the account holder on the platform – it is the basic contract between the care worker and the account holder.

“Shift invoice” is the regular (or one-off) invoice created by the care worker via the platform for the approval of and payment by the account holder.

“Vaccine” currently relates to any Covid-19 vaccine (either first or subsequent doses) administered to an approved Care Professional.

1. Terms

1.1 These terms and conditions are available on www.curamcare.ie. Our full company name is Curamio Ltd (trading as Curam), our registered company number is 778233, and our registered address and main trading address is 7/8 MOUNT STREET UPPER DUBLIN 2 D02 FT59.

Curam currently operates solely as an introductory platform in Ireland, enabling clients and Care Professionals to connect and contract directly for domiciliary care services. We do not currently provide managed or HIQA-regulated care packages in Ireland. In the future, we may offer managed care services through a regulated subsidiary, and these T&Cs will be updated accordingly if and when such services are launched.

We insist that all care sourced through the platform is delivered to the highest standards and expect all our employees, sub-contractors, suppliers, and approved Care Professionals to equally aspire to meet these standards.

Please also note that the Ecare group of companies includes Curam PAYE Ltd, which enables Curam to service commercial and government clients who require Care Professionals to be PAYE compliant – for further information on these subsidiaries’ separate T&Cs, please email us at info@curamcare.ie or telephone during office hours on + 353 126 35568. You must accept these general T&Cs and associated privacy policies to transact with the Curam group of businesses.

1.2 These terms, together with the other terms and policies referred to in section 1.5 below, govern the basis on which we provide the services available on this internet platform. Please read these terms before using the platform. Access to the Curam platform is a privilege, not a right. Our core philosophy is to put the Care Professional and the person they look after at the centre of everything we do.

1.3 If you use our platform, you agree to be bound by these terms. These terms form a legally binding contract between you and us and govern your use of the platform. If you breach these terms, we have the right to terminate your account and your right to use the platform with immediate effect.

1.4 We may change the features of our platform from time to time. We may also change these terms from time to time. If a revision is material, we will notify you where possible. If you continue to use our platform or receive services from our approved Care Professionals after any revisions take effect, you are taken to have agreed to the revised terms. These terms were last updated on 14 May 2025.

1.5 In addition to these terms, the following additional terms also apply to your use of our platform (and are, where relevant, incorporated by reference into these terms):

  • (a) Our privacy and cookies policy plus other additional policies regarding, for instance, modern slavery or discrimination;
  • (b) Any additional terms displayed on-screen or accessible via a link on the platform.

1.6 All rights granted to you under these terms will terminate immediately if you are in breach of any of them, at any time.

2. About – the Curam Platform

2.1 Curam provides an online platform for approved self-employed and employed health care workers and account holder/care recipients to connect, communicate, and arrange home care service agreements via its subsidiary Curamio Ltd. At present, Curamio Ltd does not provide managed or regulated care packages in Ireland. All care is currently arranged directly between clients and Care Professionals using the platform.

This is facilitated by providing the following services, which include:

  • A searchable online database of approved Care Professionals.
  • A jobs board where account holders can post details of a job opportunity they are looking to fill.
  • Communication tools (including mobile applications) to facilitate interaction between care workers and account holders and between care workers and fellow care workers.
  • In-platform and app messaging and Curam Meet, our secure and safe video/audio call facility.
  • Payment systems (including Mangopay, Stripe, BACS, and pre-paid cards) to enable transactions between account holders/care recipients and approved Care Professionals.
  • Monitoring tools for the platform to monitor user activity. Clients can review Care Professionals (and vice versa).
  • Feedback tools (including those controlled by approved third parties) on platform interfaces and Care Professional reviews.
  • Mobile apps for both Care Professionals and account holders/clients for secure communications and platform use.
  • Lone worker app safety feature for carers.
  • Care recipient app safety feature (due Q4 ’25).
  • Care worker notification of arrival and departure to client/account holder (due Q4 ’25).
  • Digital healthcare plan (in production). For clarity, this is a management tool for the introductory side; when regulated care is introduced, it will be mandatory for managed/regulated care.
  • Care notes feature available on the Care Professional and client app.
  • Third-party biometric identification for Care Professionals and clients by verification partners.

2.2 Platform Provision

Curam is currently an introductory services platform in Ireland. Curam provides an online multi-faceted marketplace to facilitate the process of finding and hiring Care Professionals and to provide a secure means for handling payments. It also markets and introduces Care Professionals to account holders. Curam does not directly supply Care Professionals to account holders/care recipients except via its subsidiary Curam PAYE Ltd if required for PAYE compliance. Curam does not employ Care Professional workers (through Curamio Ltd), nor does Curam act as an employment agency or care agency in Ireland at this time. The default contracting subsidiary of the Ecare Group in Ireland is Curamio Ltd unless specifically stated to the contrary.

2.3 Managed Care (Future Service)

Curamio Ltd does not currently provide or arrange for managed or regulated domiciliary care services in Ireland. Curam’s role is limited to introducing Care Professionals and facilitating the technology and payment process between clients and Care Professionals. If and when managed or regulated care services are launched in Ireland, these T&Cs will be updated and new terms will apply to those services.

2.4 Platform Constraints & Waivers

The Curam platform is used at the account holder’s/care recipient’s and approved Care Professional’s own risk. There is no guarantee that the platform will work optimally, not be subject to downtime, or be available at all times. Curam does not accept liability for losses or damages caused by the unavailability of the service, technical errors, usage errors, or use of the platform outside its intended purpose. Curam disclaims any liability for controversies, losses, injury, accidents, claims, or damages arising from the use of the online tools it provides, the engagement of Care Professionals, or the provision of care services by Care Professionals. Curam provides a range of Care Professional and client safety features, such as the Care Professional safety feature and the client safety feature, which involve activating an alarm system to nominated third parties. Curam disclaims any liability or responsibility for any faults or problems associated with the workings (or failures to work) of these software-based features.

2.5 Communications and Video/Audio Calls

You agree that our apps, email, in-platform video/audio calls, WhatsApp, and SMS will be the official means of communication with the Curam platform. We may occasionally use other messaging services or internal messaging to account holders via the platform.

We take the welfare of all users of the platform as our number one priority. We reserve the right to monitor all communications transmitted via the Curam platform. This involves recording and scanning, using various artificial intelligence and in-person review, all video/audio calls through the platform. For safeguarding and training purposes, we hold these recordings for a minimum of 30 days.

To maintain high levels of Care Professional response times and overall quality control, Curam may from time to time make use of a ‘mystery shopper’ to gauge Care Professional response times and service standards.

3. Payments, Fees, and Invoices

3.1 All payments between clients and Care Professionals must be made via the Curam platform’s secure payment system. This ensures safety, transparency, and accurate record keeping for both parties.

3.2 Platform Fees: Curam charges a platform fee for each transaction, which will be clearly displayed before any agreement is made. This fee covers the use of the platform, payment processing, and customer support.

3.3 Placement Fees: If an account holder hires or employs a Care Professional directly outside of the Curam platform, Curam reserves the right to charge a placement fee as per the rates published on www.curamcare.ie.

3.4 Invoices: Care Professionals generate shift invoices via the platform for approval and payment by the account holder. All invoices must be settled promptly and in accordance with the payment terms displayed on the platform.

3.5 Refunds: Refunds are processed in accordance with our Refund Policy, available on our website. Disputes regarding payments or refunds should be raised promptly with Curam support at info@curamcare.ie.

4. User Responsibilities and Conduct

4.1 Clients must ensure that all information provided to the platform is accurate and up to date, and that all care arrangements comply with applicable Irish law.

4.2 Care Professionals must maintain all required qualifications, permissions, and legal status to work in Ireland, and must provide care services to a high standard.

4.3 Both parties must use the platform respectfully and lawfully, and must not use the platform for any fraudulent, illegal, or abusive purposes.

4.4 Reviews and Feedback: Users may leave reviews of each other. All reviews must be honest and not defamatory. Curam reserves the right to remove any review that is abusive or inappropriate.

5. Privacy and Data Protection

5.1 Curamio Ltd processes personal data in accordance with Irish and EU data protection laws, including the General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018. Please see our Privacy Policy at www.curamcare.ie/privacy-policy for full details.

5.2 By using the platform, you consent to the collection, processing, and storage of your data as described in the Privacy Policy.

6. Limitation of Liability

6.1 Curamio Ltd provides the platform as an introductory service only. We are not a party to any service agreement between clients and Care Professionals, and we do not supervise, monitor, or control the provision of care except as required by law or in future managed care services.

6.2 To the fullest extent permitted by law, Curamio Ltd disclaims all liability for any loss, injury, damage, or expense arising from use of the platform, the actions or omissions of Care Professionals or clients, or the outcome of any care arrangement.

6.3 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

7. Suspension and Termination

7.1 Curamio Ltd reserves the right to suspend or terminate your account immediately if you breach these T&Cs or if your conduct is deemed harmful to the platform or its users.

7.2 You may close your account at any time by contacting  info@curamcare.ie.

8. Changes to the Platform and Terms

8.1 Curamio Ltd may update the platform and these T&Cs from time to time. Material changes will be notified to users where possible. Continued use of the platform after changes constitutes acceptance of the new terms.

9. Governing Law and Dispute Resolution

9.1 These Terms & Conditions are governed by the laws of the Republic of Ireland.

9.2 Any disputes arising from or relating to these T&Cs or the use of the Curam platform shall be subject to the exclusive jurisdiction of the courts of Ireland.
